Credit card information is always encrypted during transfer over networks.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
Kaizen Living Design is not responsible for the information provided on the website as to its accuracy, completeness and timeliness.
The website may contain historical information. Historical information, by nature, is not current and is provided for your reference only. Kaizen Living Design reserves the right to modify the content of the website at any time. It is the User's responsibility to monitor changes to the website.

The prices of our products are subject to price change without prior notice or information.
Kaizen Living Design reserves the right at any time to modify or discontinue the service (or any part or content) without notice.
Kaizen Living Design cannot be held liable to the User or third parties for any modification, price change, suspension or discontinuance of the service[AR1] .
SECTION 5 – PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. Such products or Services may have limited quantities and, without prejudice to the right of free withdrawal, are subject to return or exchange only in accordance with our Refund Policy: https://kaizenlivingdesign.com/policies/refund-policy.
The essential characteristics of the products are indicated on the website; however, the images and colors of the products offered for sale may not correspond to the real ones due to the Internet browser and the monitor used.[AR2]

Kaizen Living Design may limit the quantities of any products or services it offers through the website. Product prices and descriptions may be subject to updates. Kaizen Living Design reserves the right to cancel any order, but may limit or cancel quantities purchased per User, per household or per order. These restrictions may include orders placed by or under the same User account, the same credit card, and/or orders using the same billing and/or shipping address. In case of change or cancellation, you will be notified via the email and/or billing address/telephone number provided at the time of ordering. Kaizen Living Design may cancel any orders that, in its sole discretion, appear to be placed by distributors, resellers, or retailers.
The User assumes responsibility for the veracity and accuracy of the personal data entered and communicated to Kaizen Living Design during registration and when placing an order. Any damage, delay or disruption relating to and/or attributable to the inaccuracy and/or falsity of the personal data entered at the time of registration, and/or altered subsequently, will be the sole responsibility of the user and cannot be attributed to Kaizen Living Design. Before proceeding to complete the order, the User may identify and correct any errors regarding the data communicated. SECTION 7 – OPTIONAL TOOLS
The website may integrate or provide access to tools, services and/or resources of third parties, over which Kaizen Living Design has no operational control, monitoring or influence.

Kaizen Living Design assumes no responsibility for any losses, damages or results arising from the use of these external tools. By submitting/submitting any ideas, suggestions, proposals, plans, or other materials (collectively, "comments"), whether at the request of Kaizen Living Design or on your own initiative, you grant us an unlimited, perpetual, irrevocable right to edit, copy, publish, distribute, translate, and use the comments in any medium, without restriction and at any time. Kaizen Living Design is under no obligation to maintain the confidentiality of comments, to pay any compensation for their use, or to respond to them.
The User is solely and exclusively responsible for the comments he submits, ensuring that they do not violate any rights of third parties, including copyright, trademark, privacy, personality or other proprietary rights and that they do not contain illegal, defamatory, abusive, obscene material, or any type of malware or computer virus that may compromise the operation of the service or related websites.
The User will not use a false email address, nor impersonate another person, in order to mislead Kaizen Living Design or third parties about the origin of the comments.
Kaizen Living Design reserves the right, but not the obligation, to monitor, edit or remove, in its sole discretion, any content or comment that it deems to be unlawful, offensive, threatening, defamatory, pornographic, objectionable, or that violates these General Terms and Conditions or the intellectual property rights of any third party.
Kaizen Living Design assumes no responsibility or liability for any comments posted by the User or any third party.

The Website is hosted by Shopify International Ltd. (“Shopify”), which enables Kaizen Living Design to operate and manage its online store.
If you have provided consent for your personal data to be shared with Shopify, for customer experience and direct marketing purposes, Shopify may also process such whenever you visit the store or make purchases, including through services based on your interactions with other merchants and with Shopify itself.

SECTION 10 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our website or on the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, shipping costs, transit times and availability. Kaizen Living Design reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is incorrect, at any time, without notice (including after order submission). The User will be notified of the cancellation of the order and the refund of the amount paid.
SECTION 11 – PROHIBITED USES
For the purposes of these General Terms and Conditions, and in accordance with the applicable Portuguese legislation, the User is strictly prohibited from using the website or its content for: i) any purpose that violates national, European or applicable legislation, or soliciting third parties to participate in such acts; ii) Infringe or violate the intellectual property rights of Kaizen Living Design or any third party (such as copyrights and trademarks); (iii) Harass, defame, insult, slander, denigrate, intimidate or discriminate against any person on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; iv) Submitting or disseminating false, misleading or fraudulent information; v) Upload, transmit or disseminate viruses, malware or any other malicious code that may compromise the functionality, operation or security of the website or related systems; vi) Collecting, tracking, illegitimately accessing or intercepting personal information of third parties, including through methods such as phishing, pharming or scraping, in violation of data protection legislation; vii) Using the website for obscene, immoral purposes or that violate the dignity of the human person.
SECTION 12 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless Kaizen Living Design, its parent company, subsidiaries, affiliates, partners, directors, officers, agents, contractors, service providers, subcontractors, suppliers, interns and employees from any third-party claim or demand. This includes reasonable legal costs and fees that result directly or indirectly from the User's violation of these General Terms and Conditions or the User's violation of any law or the rights of third parties.
SECTION 13 – SEVERABILITY
If any provision of these General Terms and Conditions is held to be unlawful, void or unenforceable, such provision shall nevertheless be enforceable to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severable from these General Terms and Conditions, without such determination affecting the validity and enforceability of any other remaining provisions.
SECTION 14 – ACCESS AND ACCOUNT
To be able to register as a User, you must be over eighteen (18) years of age and provide the required data marked as mandatory. Kaizen Living Design is in no way responsible for the veracity of the registration data provided by the User. The User is solely responsible for the possible consequences, errors and failures that may arise from the lack of quality of the data provided.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 15 – ORDERS
By placing an order, you are making an offer to purchase. KKaizen Living Design reserves the right to accept or decline your order for any reason at its discretion. Your order is only accepted when KKaizen Living Design confirms acceptance after receipt of payment. You should carefully review the order details before submitting your order because Kaizen Living Design may not be able to accommodate cancellation requests upon acceptance.
In case of non-acceptance, cancellation or change of the order, you will be notified by e-mail to the billing address and/or telephone number provided at the time of order.
Without prejudice to the right of free withdrawal, your purchases are subject to return or exchange only in accordance with our Refund Policy: https://kaizenlivingdesign.com/policies/refund-policy
You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.
SECTION 16 – PRICES
The prices of the products are always presented to the User in euros (€), including VAT, as well as any other tax that is applicable and in force at that time. Unless expressly stated otherwise, prices shown do not include postage, handling, customs or import fees.
Kaizen Living Design reserves the right to modify prices at any time without prior notice. Any change in prices will only apply to orders placed after the date of change and publication of the new price, and the new price will not apply to orders already completed.
If the price of the products displayed on the website does not correspond to the actual price - actual price of the product - due to a programming error, malfunction of the machines or in the event that the message arrives deformed at its destination, Kaizen Living Design will take the necessary measures for its correction and communication to the User, under the applicable legal terms.
The prices published on the website may differ from the prices charged in physical stores or in other online stores operated by third parties.
SECTION 17 – SHIPPING, SHIPPING AND DELIVERY COSTS
The price of the product(s) listed on the website is accompanied by the shipping cost. The shipping cost will be determined according to the delivery method selected by the User. When placing the order and before completing it, the User will be duly informed of the shipping cost for the selected delivery method.

Kaizen Living Design undertakes to make every effort to respect the delivery deadlines indicated, which, as they do not depend exclusively on it, are merely indicative. Kaizen Living Design cannot be held responsible for damages or inconvenience caused by any delays.
SECTION 18 - Payment
To complete the order, the User will have to pay for the product(s) they wish to purchase through the website.

Invoices will be sent to the email address indicated by the User at the time of ordering or registering.
SECTION 19 - Legal guarantee of consumer goods
Under the terms of the legislation in force, the products sold by Kaizen Living Design to consumers (natural person acting for purposes that are not included in the scope of their commercial or professional activity) are covered by a legal warranty of 3 (three) years.
If the purchased product is defective, the consumer must inform Kaizen Living Design through the following email address hello@kaizenlivingdesign.com, presenting the original invoice, identifying the order number and presenting a brief description of the defect.
The consumer may also deliver the product to Kaizen Living Design's physical stores, presenting the elements and information contained above.
Upon receipt of the product, Kaizen Living Design will carry out technical verification to determine the existence and causes of non-conformity. If the technical check detects signs of misuse that imply the refusal of the warranty, the consumer will be contacted to indicate whether he wants the product to be repaired, upon request. The repair will only be initiated after express acceptance of the quote by the consumer.
SECTION 20 – RIGHT OF WITHDRAWAL
For purchases made on the website, the User has the right to terminate the purchase and sale contract, regardless of any reason, without the need to provide explanations and without any penalty.
To exercise the right of free withdrawal, the User, within 14 days from the date of receipt of the product, must send Kaizen Living Design a communication to this effect (you can use the free withdrawal form available https://kaizenlivingdesign.com/pages/withdrawal-form, through the email address hello@kaizenlivingdesign.com, or go to a store, indicating, mandatorily, the order code, otherwise the communication will not produce effects.
In addition to the order code, the User must present the purchase invoice. The product must be delivered in the same condition in which it was sold - without scratches, without external damage or signs of use, and in perfect working condition and packed in its original packaging.
In the event of exercising the right of free withdrawal, the User will bear the full costs of returning the product.
The refund of the amounts paid will be made by the same means of payment that was used in the initial transaction, unless expressly agreed otherwise by the parties.
The User may not exercise the right of free withdrawal in relation to products made according to their specifications or manifestly personalized.
SECTION 21 – EXCHANGE OR RETURN[AR4] [AR5]
In addition to the right of free withdrawal, under Kaizen Living Design's satisfaction policy, it allows the exchange or return of items purchased in https://kaizenliving design.com/pt-pt or in physical stores without incurring any costs within 14 (fourteen) days from the day following the day: (i) on which the User, or a third party indicated by him, acquires possession of the good or in the case (ii) in which the User or a third party indicated by him, acquires physical possession of the last good when the User has ordered several goods in a single order and the goods are delivered separately.
Exchanges/returns of products made to the User's specifications or manifestly personalized are not accepted.
The User must contact Kaizen Living Design directly in store or through the email hello@kaizenlivingdesign.com, communicating the intention to exchange or return the product. The product must be delivered in the same condition in which it was sold - without scratches, without external damage or signs of use, and in perfect working condition and packed in its original packaging.
In the event of a return, Kaizen Living Design will make the refund by the same means of payment or by means of store credit, according to the wishes expressed by the User.
SECTION 22 – INTELLECTUAL PROPERTY
6.1. The User accepts and acknowledges that trademarks, logos, and symbols displayed on the Website, are owned by Kaizen Living Design or are lawfully used or duly licensed in its favor.
6.2. The User acknowledges that the contents of the Website (texts, images, animations, videos, and all other information made available) are protected by intellectual property rights, and undertakes to respect such rights.
6.3. Kaizen Living Design is responsible for managing the design of all information and content made available on the Website and may update it at any time, removing or modifying any content, services, options, and features, including any corresponding changes to the presentation and respective URLs.
6.4. The User is not authorized to transmit, publicly communicate, publish, make available to the public, modify, transform, copy, sell, use, or distribute in any way the texts, images, or other information contained on the Website, or any part thereof, without the prior authorization of Kaizen Living Design or the User holding the intellectual property rights over such content.
6.5. The use of trademarks and logos on the Website, as well as the availability of materials and products therein, does not grant, and cannot be interpreted as granting, permission to Users to use such trademarks, logos, or materials, directly or indirectly.
SECTION 23 – GOVERNING LAW AND DISPUTE RESOLUTION
These General Terms and Conditions are governed by Portuguese law, and the Portuguese Courts are competent to settle any conflict resulting from them and/or the supply of any order, with the court of Kaizen Living Design's headquarters having territorial jurisdiction, with express waiver of any other.
