II – PROCESSING OF PERSONAL DATA

Personal data of natural persons is protected in Portugal by Law No. 58/2019 of August 8 (“LPDP”) and by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (“General Data Protection Regulation” or “GDPR”), which ensure the protection of natural persons regarding the processing of personal data and the free movement of such data. “Personal Data” means any information, of any kind and regardless of the format or form, including sound and images, relating to an identified or identifiable natural person. Therefore, the protection does not extend to data concerning legal entities. A person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural, or social identity (for example, their name in combination with their phone number or email address).

This Privacy Policy (“Policy”) refers to the processing of personal data carried out by Kaizen Living Design through the website kaizenlivingdesign (“Website”). The Website is hosted by Shopify International Ltd (“Shopify”) which provides an e-commerce platform enabling Kaizen Living Design to operate and manage its online store:

By reading this Privacy Policy, the user is informed about the processing of personal data carried out by Kaizen Living Design.  

III – CATEGORIES OF PERSONAL DATA 

In accordance with the purposes outlined in Section IV, the following categories of personal data may be processed:

a) Identification data (name, usernames);

b) Contact data (address, contact, email);

c) Payment details and preferences (payments are processed securely via our payment providers);

d) Order history and customer activity in store

e) Other data: any other data provided directly by the user through communications via the channels made available for that purpose.

IV – PURPOSES OF PROCESSING OF PERSONAL DATA 

Personal data we collect, and process shall be used exclusively for the following purposes:  

a)Management of the contractual relationship established with Kaizen Living Design customers. 

b) Management and processing of orders and deliveries.

c) Improving our Website and customer experience.

d) Comply with legal obligations arising from applicable data protection legislation, as well as for the exercise of rights of data subjects for use in judicial proceedings. 

Kaizen Living Design ensures the confidentiality of all data which is processed, by collecting such data and processing it in a secure manner, not allowing for its loss, manipulation or further interference, using adequate measures, as set out in section IX of this Policy

V – LAWFULNESS OF PROCESSING OF PERSONAL DATA

Kaizen Living Design shall process personal data it collects from data subjects according to the following legal basis of processing:

a) The processing of personal data is necessary for the performance of a contract between the user and Kaizen Living Design;

b) Consent to the processing of the data subject‘s personal data for customer experience and direct marketing purposes;

c) Compliance with legal and contractual obligations that Kaizen Living Design is subject to.

Users shall ensure that the data it provides is real, precise, complete and up to date, and shall be responsible for any damage or loss, direct or indirect, which may be caused as a result of providing information which does not comply with these criteria.  

In case the provided data belongs to another data subject or third party, users guarantee that said subject has been informed of the terms set out in this Policy and that it has obtained their previous authorization.  

VI – STORAGE PERIODS 

Kaizen Living Design shall only process and store personal data during the period which is deemed necessary for the purposes of processing identified above.

Kaizen Living Design maintains data in its systems to identify the data subjects according to the following criteria:

     i. during a period not beyond what shall be required for the prosecution of the purposes set out in Section IV of this Policy, insofar as legal or contractual obligations do not include provisions otherwise.

    ii. for compliance with specific legal and contractual obligations.

   iii. until the exercise of the right to erasure or opposition, which shall be exercised according to the terms set out in Section X of this Policy. 

VII –SHARING OF PERSONAL DATA 

To ensure the pursuit of the purposes set out in Section IV, we may engage processors, namely:

(i) for the delivery of the ordered products;

(ii) Processors with whom data processing agreements have been concluded;

(iii) Authorities in general, public administration bodies, and national public entities;

(iv) Marketing companies,

If you have provided your consent for the sharing of your personal data with Shopify for the purposes of customer experience and direct marketing, please note that data will be processed in this context whenever you visit the store or make purchases, including providing services based on your interactions with other merchants and with Shopify itself.

Personal data are not subject to disclosure to unspecified or undetermined persons in general.

VIII – INTERNATIONAL DATA TRANSFERS 

International data transfers outside the European Economic Area (EEA) may occur through our processor. Such transfers will be carried out in full compliance with applicable data protection regulations. Data will only be transferred to countries recognized by the European Commission as providing an adequate level of protection.

In cases where the recipient country has not been deemed adequate, Standard Contractual Clauses will be executed to ensure an appropriate level of data protection.

IX – INFORMATION SECURITY 

Kaizen Living Design has implemented appropriate technical and organizational security measures to ensure the security of personal data provided to it by the respective owners, with a view to preventing its alteration, loss, unauthorized processing, and/or access, taking into account the current state of technology, the nature of the data stored, and the risks to which it is exposed.

i) Store the data using legally required technical and organizational security measures that guarantee its security, thus preventing alteration, loss, processing, or unauthorized access, in accordance with the state of technology at any given time, the nature of the data, and the possible risks to which it is exposed;

iii) Implement physical security measures to protect the facilities;

iv) Ensure that the data is processed only by employees whose intervention is necessary to satisfy the request of the data subject, who are bound by a duty of secrecy and confidentiality. If there is a possibility that the information may be disclosed to third parties for the aforementioned purposes, they must be obliged to maintain the necessary confidentiality in accordance with the provisions of this document.

X – EXERCISE OF RIGHTS

According to GDPR provisions, data subjects may exercise their rights of access, to rectification, erasure, restriction of processing, data portability, object the processing of their data and to not to be subject to a decision based solely on automated processing. XI – SUPERVISORY AUTHORITY

Data subjects may file complaints with the competent national Supervisory Authority (Comissão Nacional de Proteção de Dados – available at www.cnpd.pt), relative to the exercise of rights or any matters regarding the protection of their personal data. 

XII – CHANGES TO THE PRIVACY POLICY

Kaizen Living Design reserves the right to review and modify this Privacy Policy at any moment it wishes. For that reason, users are advised to read this Policy reagularly.
